RWWA Stewards today concluded the adjourned Inquiry into Jockey P. Hall’s riding of YSMAEL in the straight at Belmont on Wednesday, 5 September 2012 in Race 7 the Corporate Bruce Handicap run over 1300m.
Evidence was taken from Jockey P. Hall, Licensed Trainer of YSMAEL Mr B. Watkins and Managing Part Owner Mr P. Belcastro.
Jockey Hall was found guilty to a charge under ARR.135(b) for failing to ride YSMAEL with sufficient vigour, purpose and urgency over the final 300m of the above race where in the opinion of the Stewards it was reasonable and permissible to do so to ensure that his mount was given full opportunity to win.
Jockey Hall subsequently was suspended from riding in races for a period of three (3) months effective immediately and to expire at midnight on 10 December 2012.

They either let him off or rub him out for a long time. Three months doesn't send the right message.
Having said the above, i will say the stewards are aware of that scrutiny as well and you can only surmise that they couldn't find a link to him getting a financial benefit from what happened....in which case 3 months for a bad ride could be seen as a bit tough?!?!?!?!?!?!?!?!?!

In the last race it didn't appear to straighten up like it did in the race before, so therefore it didn't let down over the last 50m...
A lot different to the Ysmael ride
I don't think there were any irregular betting movements in it though and it doesn't look too bad in the replay
Hall was charged under ARR 135 (b) not 135 (a). The 2 rules are as follows:
ARR 135 (a) Every horse shall be run on its merits.
(b) The rider of every horse shall take all reasonable and permissible measures throughout the race to ensure that his horse is given full opportunity to win or to obtain the best possible place in the field.
The difference between (a) and (b) was explained by the Queensland Civil and Administrative Tribunal in the Bobby El-Issa case:
"[47] The alternate charge [i.e. 135(b)] to this that every rider shall give his horse all reasonable and permissible measures to insure the horse is given full opportunity to win or obtain the best possible place in the field. This does not necessarily involve a deliberate or conscious act or moral turpitude on the part of the jockey. It means that a rider did not, perhaps, take an opportunity that was open to the rider or perhaps would have taken some other measure to give the horse the best opportunity in the field, for example, the rider in considering a number of options may have chosen the wrong option."
The Tribunal in that case also noted:
"[69] . . . Comparable case indicate that a breach of ARR 135(b) attracts a penalty of up to about 6 months depending on the circumstances. As this is a lesser charge not involving a deliberate and conscious act, a breach of ARR 135(a) is obviously more serious."
In this case Hall rode Ysmael perfectly until the last 100 or so metres when he should have used the whip. Hall moved Ysmael off the rail at the 600m and brought him into the race on the corner. That's why he was charged under ARR 135(b) and why he only got 3 months i.e. the stewards appear to have considered it was an error of judgment and not a deliberate and conscious act - which would have warranted him being charged under ARR 135(a).
This case does bear some similarities to the El-Issa case because El-Issa also rode the perfect race until the 200m after which he failed to use enough vigour. However there were other factors in that case which led the stewards to charge El-Issa under ARR 135(a) and which resulted in him getting 18 months.

No mention on Perth Racing re this matter, but for those starved of anything to read and believe, there is a lovely piece on seldom spoken about Stallion Trade Fair, under the banner "The Winners Keep Coming". Now hailed by the impartial WATC as 'WA's best value sire".

Daniel Staeck got a similar sentence for same thing on Siesta Bay (and also Dexian). No allegation or substantiation of any betting misdeeds, just a (in opinion of stewards) blatant error of judgement that cost said horses the race.
So right or wrong, the precedent is there for a 'middling' sentence.
Obviously Watkins is of the opinion the stewards have got it wrong....surely if he believed Hally was guilty ( as the stewards have found ) you would have to think P Hall would never throw another leg over a Watkins trained galloper !!!!!!!

hall all will have terrible weight problems.with 6 mths off. we all know he enjoys a bevvie or 2...

he's pulled the horse up basically the whole way up the straight.. had it reefing and tearing against while he's sitting up on it trying to restrain it, unbelievable stuff
