Race 7: WARWICK RSL MEMORIAL CLUB CLASS 2 H'CAP - 1350M
1st - Seeyou 2nd - Requested 3rd - Toronto Dancer 4th - Temple Court

TORONTO DANCER (B. Looker) was inclined to hang out in the straight and from the 200m to the winning post shifted out and made contact with REQUESTED on several occasions.

Stewards opened an inquiry into the reasons for S. Scriven, the rider of REQUESTED, losing his whip near the 100m and then the subsequent actions of both S. Scriven and apprentice B. Looker, the rider of TORONTO DANCER, over the final 100m and the circumstances in which S. Scriven obtained apprentice Looker's whip. After taking evidence from both riders and trainer D. Schmidt, master of apprentice Looker, the inquiry was adjourned to a time and date to be fixed.

    It was established rider Ben Looker had accidentally knocked Scriven's whip from his hand and in retaliation Scriven grabbed Looker's whip inside the final 100 metres of the Warwick RSL Handicap.

    the stewards obviously saw what happened and decided it was ok???

    Why didn't the jockey Looker protest?

    Why didn't the stewards establish why Looker didn't protest?

    And yes why was that horse allowed to retain second placing. The stewards could have demoted it.

    There should be an inquiry regarding the stewards' actions.

    Apparently one of the reasons the stewards did not enter a protest was that they thought that if a protest was upheld there would have been a counter protest fro Scrivo over interference which occurred prior to the whip incident.

    Scrivo confirmed to a reporter that he would have done so.

    I'm amazed he would have had the cheek to even consider doing that after his on track behaviour. Surely they would have dismissed a protest of his anyway... they are the stewards after all.

    Actually it was a white chocolate easter bunny for the record. Was quite nice.
  • last time I can remember this involved Peter Cuddihy and K Banks in NSW, am sure one of them got time. It was about the same time as the Mr Digby case.

    Gotta get minimum 6 weeks, its improper riding, Scriven only hits them on the chest, what I couldnt understand why the hell did he give it back straight after the line

    watched the replay this morning on the news........... only in qld......... i didnt even notice it until i watched the head on but it goes to show though that the 'old school' jockeys carent keep up with the 'modern' day jockeys and by saying this i mean that if this was a 'modern' jockey or a jockey in touch woth the 'modern' riding style he would've sat down and punched it out hands and heels

    benny said he didn't protest cos he was basically in shock he'd never been in that position and he didn't know he could. apparantly the stewards never saw it tell well after correct weight was given.

    5months seems excessive tbh. I wouldve thought 2-3 would be enough
  • would have been 6 but they took a month off for pleading guilty

    I reckon its fair - was a very blatant and deliberate breach of rules

    Had to laugh at a comment I saw on twitter in reply to q q1uery ad to whether this had occurred before.

    Lester Piggott took Alain Lequeux's whip in a finish at Deauville. I've read he got 20 days & sneered "he wasn't going to need it"
  • Schumacher got life for cheating in a race (later reduced to 6 years) - so Scriven could feel a bit lucky in that respect

    Scriven is very very fortunate. Who gave him the sentence? Someone from WA Law Courts?

    the general consensus in the east with most participants is that he's been harshly treated. considering j.lee only got 6 weeks for dropping his hands. (haven't seen that race so not sure how severe it was)

    Background according to stewards

    ? Scriven's conduct put his own and Apprentice Looker's safety at great risk.

    ? Scriven's actions subsequent to losing his whip were intentionally designed to improperly improve his prospects in the race while disadvantaging another rider's chances; and

    ? Actions such as this had the capacity to tarnish the image of Racing and any penalty that is applied must serve as a deterrent to Jockey Scriven and to others who may be inclined to take matters into their own hands.

    S Scriven's was suspended for six (6) months but taking into account Scriven's guilty plea, the remorse he had shown, the way in which he conducted himself, his outstanding race riding record and the fact that he will find it more difficult to return to race riding than most given his age and history of weight issues, it was reduced to 5 months.

    **Trainer K Schweida (REQUESTED) was asked to make submissions in regard to whether or not the Stewards ought to invoke the powers under AR136(1) in relation to REQUESTED retaining its second placing.

    Stewards determined that the actions of Jockey S Scriven over the concluding stages were such that it would be inappropriate to allow his mount to retain it's placing in the race. They were also of the view that regardless of whether a protest was considered on the day, the actions of Scriven were such that REQUESTED should be disqualified from the race and amended the placings accordingly:

    Apprentice B Looker in the presence of his master Trainer D Schmidt was found guilty of a charge under AR140 (d) which reads;

    **AR140 (d) Any loss or breakage of gear during a race, or any unusual happening in connection therewith, shall be reported by the owner and/or trainer and/or rider to the Stewards immediately after the race

    Apprentice Looker as the rider of TORONTO DANCER failed to report to stewards immediately after the race the unusual happenings, that being that the whip that he had carried had been forcibly taken from his grasp by Jockey S Scriven inside the 100m.

    Apprentice Looker's license to ride in races was suspended for a period of two (2) weeks to commence at midnight Saturday 30th April 2011 and to expire at midnight Saturday 14th May.


    **JASON LEE (Set Match) ? NEWCASTLE

    Pleaded guilty to a charge under AR 137(b) in that as the rider of Set Match he failed to ride the horse out to the end of the race.

    J Lee?s licence to ride in races was suspended for a period of six weeks . In assessing penalty stewards took into consideration that in their opinion J Lee?s action had cost Set Match the race

    So who is going to ride Scenic Shot?

    It was a stupid thing to do - got what he deserved! Can't try and justify those actions anywhere in Australia or the world!

    Hopefully he won't do it next time the opportunity arises!

    Scrivo is lucky Looker was intimidated, another rider may have belted the shit out of him!

    Love Scrivo super rider but time of in the winter he could blow up as his weight is always a concern
